Breakpoint: Organ Donation and “Presumed Consent”

 By John Stonestreet and Kasey Leander In a spiraling culture of death, Canadian jurisdictions disregard bodily autonomy by opting in residents by default. Following the lead of the province of Nova Scotia, New Brunswick became the second jurisdiction in Canada to adopt a policy of “presumed consent” for organ and tissue donation. Instead of willingly opting in to be an organ donor, residents 19 years and older, with limited exceptions, will be opted in by default. While many see this as a solution to the perpetual demand for transplant organs, laws like these treat the ethics of organ donation as a settled matter while treating humans and their bodies as means to other ends. Even more, considering Canada’s policy of Medical Assistance in Dying (MAID), this step will corrode the already thin ideas of “autonomy” and “consent” while incentivizing a utilitarian view of human nature. Published August 12, 2022  The Christian Institute has not been involved in the tragic case of Archie Battersbee. We can only reflect on what is in the court judgments, media coverage and other comment in the public domain. Archie was found unconscious and not breathing by his mother on 7 April 2022. He was rushed to hospital, where he received further medical attention, but never regained consciousness. After a legal battle, in which Archie’s family were supported by the Christian Legal Centre, his life support was removed on 6 August. First and foremost, we extend our sympathy to Archie’s family. They have been through a harrowing ordeal, and we pray that they will know God to be the Father of compassion and God of all comfort. The case was highly complex. The American College of Physicians (ACP) wrote in a position statement published last Sept. 19 in the Annals of Internal Medicine that the organization of 152,000 medical professionals stands against the legalization of physician-assisted suicide, “the practice of which raises ethical, clinical, and other concerns.” “Control over the manner and timing of a person’s death has not been and should not be a goal of medicine,” the group concluded. “However, though high-quality care, effective communication, compassionate support, and the right resources, physicians can help patients control many aspects of how they live out life’s last chapter.” The position paper came in response to increasing public interest in legalizing euthanasia to promote patient autonomy
